Buffalo Niagara Medical Campus, Inc. (hereinafter “BNMC”) (hereinafter referred to as “us,” “we,” “our,” or “Company”) has created the following Privacy Policy for when you visit our website: https://bnmc.org (hereinafter the “Website”).  This Privacy Policy describes, among other things, the types of information we collect about you, how we use it, and how you can access your information.

This Privacy Policy is governed by our Terms and Conditions  of Use.  By using our Website and our services, you consent to the terms of our Privacy Policy and Terms and Conditions of Use.  If there are inconsistencies between the Privacy Policy and the Terms and Conditions of Use, the Privacy Policy controls.

   I.               INFORMATION WE COLLECT ABOUT YOU

To operate our Website and provide you services, we may collect the following types of information, which are described in more detail below: (A) information you provide to us, (B) information we automatically collect, and (C) information we receive from third parties.  All of the information listed in (A)-(C) above, are detailed below, and hereinafter referred to as “Information.”  This Privacy Policy places no restriction on the use of Information that has been de-identified or anonymized.

  1. Information You Provide To Us:You may provide your Information to us during your interactions with our Website, such as when you access various content or features, contact us directly, sign up for services, or other areas in which you otherwise interact with our Website. In using our Website, you may provide us with Information, including, without limitation:

  2. Information We May Automatically Collect:
    We also collect information about you from your visit to our Website including:

We use a few different technologies to collect this Information:

o   Cookies.  The Website may place small files, called “cookies” onto your computer to record pages you visit and identify you as a unique user.  Cookies make your use of our Website more pleasing and efficient.  Most web browsers automatically accept cookies, unless you have configured yours not to accept them.  If you do not accept cookies, then you may not be able to use certain portions of the Website.

o   Web Beacons.  Small graphic images or web programming code called web beacons (also known as “pixel tags” or “clear GIFs”) may be included on the pages of the Website and in email messages we send you.  Web beacons or other similar technologies may be used for several purposes, such as to count visitors to the Website, monitor how you navigate the Website or to count how many particular links posted on the Website were actually viewed.

o   Mobile Device Identifiers.  Certain mobile service providers uniquely identify mobile devices and we, or our third-party service providers may receive such device information if you access the Website through a mobile device.  Certain features on the Website may require collection of mobile phone numbers and we may associate that phone number to mobile device identification information.  Additionally, some mobile service providers operate systems that pinpoint the physical location of devices that use their services, which may be received, along with other Information, by us or our third-party service providers.

o   Embedded Scripts.  An embedded script is programming code designed to collect Information about your use of the Website, such as the links you click on.  The code is temporarily downloaded to your computer from our web server or a third-party provider, is active only while you are connected to the Website and is deactivated or deleted once you leave the Website.

o   We, or third-party service providers with whom we collaborate or contract with to perform services on our behalf, may use your Information to text, email, or contact or share with you with information that we believe may be useful to you, such as information about products or services provided by or through us through permissible targeted advertisements or related to our Website.  You consent to these communications.  You may opt-out of receiving permissible targeted advertisements by using the NAI Opt-out tool available at http://optout.networkadvertising.org/?c=1.

o   Some users engage a Do Not Track (DNT) setting to indicate a preference regarding tracking by advertisers and other parties.  We do not respond to DNT signals .

  1. Information We May Receive from Third-Parties

We may collect additional Information about you from third-party websites, or sources providing publicly available information, to help maintain and support your account.  We reserve the right to request any additional Information necessary to establish and maintain your account for use of the services and access to the restricted areas.

This Privacy Policy places no restriction on the use of Information we automatically collect from your visit, or de-identified or aggregated information that will remove references to an identified individual and/or make the data anonymous.

  1.    Use and Purpose of Processing Your Information

We use and process your Information above for things that may include, but are not limited to, the following:

o   To respond to your inquiries and provide you with requested information such as our newsletter, job openings, tours, and/or requests for proposals and responses to them;

o   Communicate with you regarding our services, provided that you have not already opted-out of receiving such communications;

o   Improve our Website and resolve any technical problems;

o   Provide targeted advertisements to you;

o   Comply with our Terms and Conditions of Use;

We generally keep Information for so long as it may be relevant to the purposes listed above, consistent with any applicable laws and agreements.  Data may persist in copies made for backup and business continuity purposes for an additional time.

We may share Information, such as aggregate user statistics, with third-party service providers.

o   Disclosure of Customer Information for Legal and Administrative Reasons.  We may disclose your Information without notice when required by law or to comply with a court order, subpoena, search warrant or other legal process or as part of any internal or external investigation or inquiry or other legitimate business need.

o   Business Transfers.  Your Information may be transferred, sold or otherwise conveyed (“Conveyed”) to a third-party where we: (i) merge with or are acquired by another business entity; (ii) sell all or substantially all of our assets; (iii) are adjudicated bankrupt or (iv) are liquidated or otherwise reorganize.  You consent to any and all such Conveyances of your Information.

o   Online Postings.  If you chose to share with us comments, postings, photos, testimonials, or other Information you consent and agree that we may make it available generally to the public and it will not be returned to you unless we receive such a request.

Except as provided in this Privacy Policy, we will not sell, rent, or license your Information we have collected to any third-party without your consent.

III.             LINKS TO THIRD-PARTY WEBSITES AND SOCIAL MEDIA FEATURES

While on the Website or when receiving communications from us, you may encounter links to other third-party websites or social media platforms, such as Facebook, Instagram, LinkedIn, Twitter or YouTube.  We are not responsible for the privacy and security practices of those websites or the information they may collect (which may include IP address).  You should contact such third-parties directly to determine their respective privacy policies.  Links to any other party’s website or content do not constitute or imply an endorsement or recommendation by us of the linked website or content.

IV.             INFORMATION PROTECTION

We use industry-standard procedures and safeguards to help protect the confidentiality of your Information.  However, you should assume that no data transmitted over the Internet or stored or maintained by us or our third-party service providers can be 100% secure.  Therefore, although we believe the measures implemented by us reduce the likelihood of security problems to a level appropriate to the type of data involved, we do not promise or guarantee, and you should not expect, that your Information or private communications will always remain private or secure.  We do not guarantee that your Information will not be misused by third-parties.  We will not have any liability for misuse, access, acquisition, deletion, or disclosure of your Information.

If you believe that your Information has been accessed or acquired by an unauthorized person, you are required to notify us so that necessary measures can be taken immediately.

V.               CONSENT TO TRANSFER

The Website is hosted in the United States.  If you are located outside of the United States, please be aware that information we collect will be transferred to and processed in the United States.  By using the Website, or providing us with any Information, you consent to this transfer, processing and storage of your Information in the United States, a jurisdiction in which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.  We do not represent that our Website is appropriate or available in any particular jurisdiction.

VII.          CONSENT AND OPT-OUT

By submitting your Information you consent to receive e-mails, texts, or phone calls about the Website or our services that we believe may be of interest to you and you consent to the collection and use of your Information as set forth in this Privacy Policy.  If you withdraw consent, you agree that despite withdrawal we may continue to use your Information previously provided to us to the extent that we are legally or contractually obligated to do so and to the extent necessary to enforce any contractual obligations you may have to us.  You also understand that in withdrawing consent, we may no longer be able to provide you with services previously available with consent.

VIII.       CHILDREN’S INFORMATION

The Website is intended only for users over the age of eighteen (18).  If we become aware that a user is under thirteen (13) (or a higher age threshold where applicable) and has provided us with Information, we will take steps to comply with any applicable legal requirement to remove such information.  Contact us if you believe that we have mistakenly or unintentionally collected information from a child under the age of thirteen (13).

IX.          CHANGES TO THIS PRIVACY POLICY

We reserve the right to change, modify, terminate, or amend this Privacy Policy at any time and for any reason.  If we modify our Privacy Policy, such changes will be effective upon posting.  It is your obligation to check our current Privacy Policy for any changes.
